Following the Dobbs decision, state prosecutors have expressed their willingness and intention to aggressively enforce their state abortion bans. Certain “zombie statutes” that pre-dated Roe have now become the law in various states and provide a vehicle through which prosecutors can seek to prosecute certain conduct–within and outside their states. Given the increase in laws restricting abortion–and abortion-related travel–hotels may get swept into criminal and/or civil investigations of women who cross state lines to get abortions.
Hotels are likely going to be asked for information regarding certain hotel guests, and there is an increased risk of the use of legal process (subpoenas and search warrants) on hotels in connection with investigations into potential violations of abortion bans by health care providers, payors and other third parties. The aiding and abetting theory of liability is one potential way that hotels could face potential liability themselves. This risks are exacerbated by the numerous employers providing travel benefits to women seeking abortions.
The program will address the wider issues surrounding the maintenance and protection of sensitive, personally information. Among other things, hotels will need to determine how and when to retain, store, and limit access to the personally identifiable information they possess. Hotels need strong internal policies, especially on matters concerning how to respond to requests for information.
